9. SMS Notifications and Terms

Brik CRM provides messaging functionality that allows businesses using the platform to communicate with their customers via SMS. These messages may include appointment confirmations, service reminders, technician arrival notifications, estimates, invoices, job updates, and other service-related communications.

9.1 Consent

Messages are sent only to individuals who have provided their phone number to the business and have consented to receive SMS communications. By providing a phone number through a service request form, booking, estimate request, or other communication channel, users consent to receive SMS messages related to their service request or account activity.

9.2 Message Frequency and Rates

Message frequency varies depending on the customer's interaction with the business and the services requested. Message and data rates may apply depending on the recipient's mobile carrier and plan. SMS delivery is subject to carrier availability and may be delayed or not delivered depending on the recipient's mobile network.

9.3 Opt-Out and Help

Recipients can opt out of SMS communications at any time by replying STOP to any message. Once opted out, the user will no longer receive SMS messages from that business unless they opt in again. For assistance, reply HELP to any message or contact the business directly.

9.4 Mobile Data Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Phone numbers, mobile information, and other personal data collected through the platform are never sold, rented, or shared with third parties, and are used solely for operational communication purposes such as service notifications, appointment reminders, invoices, account updates, and to deliver the Service you have requested. Information may only be disclosed to subcontracted service providers (e.g., SMS gateway, hosting, payment processing) strictly to support delivery of the Service, and these providers are contractually prohibited from using your information for any other purpose.

9.5 Platform Responsibilities

Businesses using the Brik CRM platform are responsible for obtaining proper consent from their customers before sending SMS messages. Brik CRM provides tools to facilitate consent collection, but each business is independently responsible for compliance with applicable messaging laws and regulations, including TCPA and CTIA guidelines. Brik CRM messaging services comply with CTIA guidelines and U.S. carrier requirements for A2P 10DLC messaging.

10. Your Privacy Rights

Depending on your location, you may have the following rights regarding your personal information:

10.1 Right of Access

You have the right to request a copy of the personal data we hold about you. We will provide this information in a structured, commonly used, machine-readable format.
